Terms of Service whatswork

Please read these terms carefully. By registering for, accessing, browsing and/or otherwise using the Whats.work Service, you acknowledge that you have read, understood and agree to be bound by these Terms. If you do not agree to be bound by these Terms, do not access, browse or otherwise use the Platform or Service.

1. Introduction

1.1 Mission

We believe the future is about people. Students often do simple jobs but can do so much more. What they lack in work experience, they more than compensate in skills. They grew up with digital and are eager to get work experience.

Whats.work matched local entrepreneurs with local students and young professionals. Whats.work is not an intermediary, employment agency or secondment agency.

1.2 Scope

Working at the minimum hourly rate per age is outdated. The platform Whats.work offers tools enabling students to decide when they work, whom they work for and how much they want to earn.

These are the Terms for the Service called Whats.work, which is provided by FindMatchWork B.V. whose registered office is at Lisdoddelaan 92, Amsterdam, registered at the chamber of commerce of Amsterdam (the Netherlands), registrant number being 83274588 – through the url https://www.whats.work. 2. Definitions

Account

The (primary) means through which a Member has access to the Platform through his/her Login credentials.

Content

Any data and information available through the Whats.work Service or contained within the Mobile application, Website, Platform, presentations, blogs, articles, documents, pictures, images or other informational materials.

Employer

An organisation using the Platform for recruitment and/or employer purposes.

Login credentials

A combination of a Member’s email address and password that gives the Member access to his/her Account. If a Member has registered an Account through his/her account with certain third-party social networking services, like Facebook or Google, this account will serve as Login Credentials.

Whats.work Materials

The visual interfaces, graphics, design, systems, methods, information, computer code, software, services, look and feel, organisation, compilation of content, code, data and all other elements of the Whats.work Services.

Member

The natural person who has accepted these Terms.

Member Data

Files and any other digital data and information, which is uploaded to the Whats.work Platform by a Member.

Platform

The Whats.work application which is accessible via the Website or via our Mobile applications.

Whats.work Service

The Mobile application, Website, Platform, Content and all content, services and/or features available through the Platform.

3. Relevance

3.1 Legally binding agreement

When accepted by you (as defined above), these Terms form a legally binding contract between you and Whats.work.

3.2 Disagreement with these Terms

In the event that you not agree with (parts of) these Terms, then you may submit a written request to Whats.work for different provisions. This can be done by sending an email to info@whats.work.

4. Modification of these Terms

Whats.work reserves the right, at its sole discretion, to change, modify, add, or remove portions of these Terms by posting such changes on or through the Platform or the Whats.work Service. Please check these Terms periodically for changes. Your continued use of the Whats.work Service after such changes have been posted (as provided above) constitutes your binding acceptance of such changes. Such amended Terms will automatically be effective upon the earlier of (i) your continued use of the Whats.work Service, or (ii) 30 days from posting of such modified Terms on or through the Platform. Notwithstanding the foregoing, the resolution of any dispute that arises between you and Whats.work will be governed by the Terms in effect at the time such dispute arose.

5. Our responsibilities

5.1 Provision of the Whats.work Service

Whats.work will make the Whats.work Service available to a Member pursuant to these Terms.

5.2 Protection of Member Data

Whats.work will maintain administrative, physical and technical safeguards for protection of the security, confidentiality and integrity of Member Data. Those safeguards will include, but will not be limited to, measures for preventing access, use, modification or disclosure of Client Data by Whats.work personnel except (a) to provide the Whats.work Service and prevent or address service or technical problems, (b) as compelled by law or (c) as a Member expressly permit in writing.

By agreeing to these Terms, a Member grants Whats.work a general authorization in the meaning of Article 28 (2) of Regulation (EU) 2016/679 to engage processors for the purposes of providing the Whats.work Service. Whats.work will inform the Member of changes in such processors in accordance with the procedure of modifying these Terms as stipulated in section 4 of these Terms.

6. Member data

6.1 Being considered as a Member

Certain features, functions, parts or elements of the Whats.work Service can be used or accessed only holders of an Account. The person who wishes to create an Account must:

1. Complete the sign-up form on the Whats.work Platform; and

2. Accept these Terms by clicking “Sign up” or a similar button.

From the moment the person completes this process is considered a Member.

6.2 Accurate and true information

A Member warrants to Whats.work a guarantee that all the information that a Member has entered in the sign-up form and/or uploads to the Platform (Member Data) is accurate and true. If Whats.work has a valid reason to believe that the information that provided by a Member is incomplete, untrue, misleading or incorrect, then it is entitled to delete the information and if it so wishes, to terminate the Account of the concerning Member entirely.

6.3 Restriction to create a Account under someone else’s name

It is not allowed to create an Account under someone else’s name unless this person has given permission to do so.

6.4 Confidentiality of a Member’s password

A Member is responsible for the confidentiality of his/her password, which gives access to his/her Account. It is not allowed for a Member to grant access to his/her Account to any third party organisation under any circumstances.

6.5 Personal Account

An Account is assigned to a designated individual person and is not transferable.

6.6 Termination of Account

A Member may terminate his/her Account by following the designated steps after clicking “Delete my profile” in the “Personal settings” section of the Platform. Whats.work will delete all Member Data following the termination of his/her Account.

6.7 Termination of Account by Whats.work

Whats.work has the right to terminate a Member’s Account for no or any reason, at any time, with or without notice.

7. Use of the Platform

7.1 Eligibility to use the Platform

Only users that are older than 16 years old are eligible to use the platform.

7.2 Restrictions of use

A Member is not allowed to use the Platform:

  1. For any unlawful cause;

  2. For any direct or indirect commercial purposes;

  3. In any way resulting in a diminished functionality of the Platform or that may cause damage to the functionality of the Website or Platform;

  4. For spreading, sending or uploading computer viruses or other files or software that cause damage to the functionality of the Website or Platform, other Members and/or Employers;

  5. For spreading, sending or uploading material to the Platform that is slanderous, insulting, obscene or threatening of nature or that may lead to irritation, inconvenience or unnecessary commotion;

  6. To scrape, crawl or spider any data available on the Website or Platform; and/or

  7. In a way that results in an infringement of any right of any person or legal entity;

8. Intellectual Property Rights

8.1 Whats.work’s Intellectual Property Rights

The Whats.work Service, Whats.work Materials, Whats.work trade names and trademarks, and any parts or elements thereof are solely and exclusively owned and operated by FindMatchWork B.V.. Any commercial or promotional distribution, publishing or exploitation of the Whats.work Materials is strictly prohibited unless you have received the express prior written permission from FindMatchWork B.V.. FindMatchWork B.V. reserves all rights to the Whats.work Service, Whats.work Materials and Whats.work trade names and trademarks not expressly granted in the Terms.

8.2 Prohibited to copy, alter or use source code

It is prohibited to alter the source code of the Platform or Website, to use it as the basis for any work or to try to retrieve the source code in any way or sell, vest, sub-license, transfer or establish any right on the information or source code.

9. Privacy

Whats.work takes the privacy of its Members very seriously. Whats.work’s Privacy Policy at https://whats.work/privacy-policy/ is hereby incorporated into these Terms by reference. Please read the Privacy Policy carefully as it governs Whats.work’s collection, use, process and disclosure of Member’s personal information.

10. Disclaimer and limitation of liability

10.1 Disclaimer

Whats.work accepts no liability for any damage following from the use of the Mobile application, Website, Platform and/or Whats.work Service.

10.2 No liability

In no event shall we be liable for any claims, penalties, loss, damage or expenses, howsoever arising, out of or in connection with your use of the Mobile application, Website, Platform and/or Whats.work Service, including, without limitation, direct or indirect loss, consequential loss or damage, loss of profit or goodwill, loss of data, loss arising from use or inability to use the Mobile application, Website, Platform and/or Whats.work Service, loss arising from any errors or omissions in the Mobile application, Website, Platform and/or Whats.work Service, as a result of a breach of contract, negligence or delict.

11. Applicable law, choice of court, void and voidable terms

11.1 Governing law

These Terms are governed by Dutch law.

11.2 Choice of court

In the event of a conflict between a Member and Whats.work that cannot be settled or concluded in any other way, the only designated court is the authorized court in Amsterdam.

11.3 Severability

If any provision of these Terms is judged to be illegal or unenforceable, the continuation in full force and effect of the remainder of the provisions shall not be prejudiced.
